The Opinion of Rogério Alves

14 Apr. 2014

I have said this and written numerous times: the reform of the Justice system has a final and powerful obstacle: our endemic conservatism. This would be a matter that could be subject to a wider analysis since it is central issue in our culture. We are slaves of our routines which now hinder our common sense. Nowadays, I have come to witness the following in our judicial system - the one everyone refers to as being slow. We are in a court session, either in a civil or criminal matter. A witness is being heard and everything is being tapped on record. In the midst of such proceeding, it is necessary to add documents to the proceeding, due to their relevance to the case. As soon as such request is made, the record system is turned off and legal dictation ensues. The party who wants to include the document dictates to the legal officer, who writtes. Then, the other parties dictate their saying. If the Court decides therein, it shall also dictate. The proceeding which would take one minute - if the recording would exist - takes now ten minutes.

But why is this the proceeding undertaken? How many hundreds (or thousands) hours would be saved in a year if this proceeding was changed? Why is the recording system turned off? Is it now crystal clear that if the recording would be kept running, the proceeding would be quicker, easy and reasonable? And if it is so, why does this proceeding remains the same? One thing is for sure, if each legal case could go faster this would lead to a better system. It is time to put these routines to rest.
